(Woodland, CA) – July 22, 2020 – Over the past several weeks, four more individuals previously released from custody as a result of California Judicial Council’s Statewide Emergency “0” Bail Schedule were charged with new felony crimes. The “0” Bail Schedule became effective April 13, 2020, in response to the COVID-19 pandemic. On June 11, 2020, the Judicial Council rescinded its order mandating the bail schedule but urged counties to voluntarily continue its use. On June 18, 2020, the Yolo County Superior Court announced it would continue to use the Statewide Emergency Bail Schedule.
West Sacramento man, Michael Cole, age 31, was arraigned on June 24, 2020, on a charge of robbery after being arrested by the West Sacramento Police Department. Because robbery is a “violent” felony, it is one of the 13 exceptions to “0” bail, and bail was set. Cole was also arraigned that same day on a complaint alleging possession of a stolen vehicle from an arrest on April 26, 2020. After his arrest on April 26, 2020, he was released on $0 bail and pending arraignment on those charges at the time he was arrested for robbery. At his arraignment, he pled not guilty and bail was set at $10,000. He was released on bail but then failed to appear in court on July 8, 2020. The court held his bench warrant until his next court appearance on July 22, 2020, at which time he again failed to appear. A bench warrant has been issued for his arrest.
Winters man, Juan Gastelum, age 35, was arraigned on June 30, 2020, on a charge of attempted vandalism after being arrested by the Winters Police Department on charges of assault with a deadly weapon on a peace officer and vandalism. At the time of his arrest he was out of custody due to the “0” bail schedule after a previous arrest for vandalism. On the same day he was released, he was again arrested, this time by Yolo County Sheriff deputies for trespassing. He was released with a notice to appear. Gastelum’s pending charges include vandalism, trespassing, bringing drugs into the jail and calling 911 with the intent to annoy, possession of a controlled substance. After he pled not guilty, bail was set at $20,000. His next court date is August 5, 2020.
Sacramento man, Christopher Appleby, age 37, was arraigned on June 30, 2020, on charges of assault by means of force likely to produce great bodily injury and attempted robbery after being arrested by the West Sacramento Police Department. Because robbery is a “violent” felony it is one of the 13 exceptions to “0” bail, so bail was set. Appleby had been previously arrested on a warrant for a probation violation after being convicted in 2017 for assault by means of force likely to produce great bodily injury and was released on “0” bail. After he pled not guilty, bail was set at $50,000. His next court date is July 28, 2020.
Woodland man, Jose Indalopez, age 36, was arraigned on July 2, 2020, on charges of unauthorized entry into a residence after being arrested by the Woodland Police Department. At the time of his arrest he was out of custody due to the “0” bail schedule. He was subsequently cited for possession of drug paraphernalia and arrested for vehicle theft, possession of drug paraphernalia, petty theft and prowling. Indalopez was arraigned in separate complaints for assault on a peace officer and public intoxication; vehicle theft; prowling; as well as violations of probation from four separate misdemeanor cases. After he pled not guilty, bail was set at $15,000. His next court date is July 30, 2020.
